Party wall surveyor East London: the wall three owners share, and the owner nobody can find

The party wall procedure itself is the same in Bow as in Bath. What East London adds is a service problem. A single Victorian terrace here is often three or four separately owned flats, at least one let out through an agent, sometimes with a freeholder at an address nobody on the street has. The Act requires notice on every adjoining owner, and getting that right is most of the work before a surveyor is appointed at all.

Count the owners before you count the walls

The Act's definition of owner is wider than the person who answers the door. A converted terrace can have a leaseholder in each flat and a freeholder over all of them, and each of those is an adjoining owner who has to be served. Missing one does not merely annoy them; it leaves the notice defective, and a defective notice means the work has no statutory authority whatever an appointed surveyor later writes. Pull the titles for the adjoining properties before drafting anything.

How to serve when nobody will take it

Section 15 allows personal delivery, post to a usual or last known residence or place of business, and delivery to the secretary or clerk at a company's registered office. Where the owner cannot be named there is a further route: address the notice to the owner of the named premises and either hand it to somebody there or fix it to a conspicuous part of the premises. That last route exists precisely for the absent landlord, and it is the one East London jobs most often need.

Solid walls and terraces built as one

Most stock here predates cavity construction, so the party wall is a single leaf shared by both houses, sometimes shared along a run of three. Cutting into it for a beam, chasing it for services, or underpinning it, all reach the neighbour's half directly, and vibration travels further along a terrace than owners expect. It is also why the schedule of condition matters more here: pre-existing cracking is universal in this stock, and without a record taken beforehand every crack becomes an argument afterwards.

One surveyor or two

If the adjoining owner agrees, a single agreed surveyor acts for both and the award costs roughly half. Where there are four adjoining owners, an agreed surveyor is worth pursuing hard, because four separate appointments on a modest rear extension can cost more than the extension's steelwork. Remember what the appointment is: the surveyor is a statutory appointment resolving the dispute, not an advocate for whoever pays. That is the point owners in a dense street most often have to be told twice.

Questions people ask about party wall surveyor east London

Who has to be served in a converted terrace?

Every adjoining owner as the Act defines owner, which in a converted house usually means the leaseholder of each flat and the freeholder. Serving one and not the others leaves the notice defective.

What if the neighbouring flat is let and the landlord is untraceable?

Section 15 lets a notice be addressed to the owner of the named premises and either handed to somebody there or fixed to a conspicuous part of the premises. Keep dated photographs of what was fixed and where.

Can one surveyor act for both sides?

Yes, if both owners agree to an agreed surveyor. It is markedly cheaper, and in a street where several owners have to be served it is usually the difference between a proportionate fee and an unreasonable one.

Why does a schedule of condition matter so much in a terrace?

Because this stock already carries cracking before anybody starts. A record of the neighbour's condition taken before work protects both sides, and without one every existing crack becomes a claim.
